CLIENT'S OBJECTIVES AND PROJECT OVERVIEW:

The Coffs Harbour Bypass is a 12 km bypass from south of Englands Road intersection to Korora Hill in the north, and a 2 km upgrade of the existing Pacific Motorway from Korora Hill north and Sapphire. The Project will save motorists 11 minutes travel time, bypass up to 12 sets of traffic lights and remove thousands of vehicles from the Coffs Harbour CBD.

The project included:

a four-lane divided highway from south of Englands Road to the dual carriageway highway at Sapphire
three tunnels and numerous structures that pass over or under local roads, creeks and the North Coast Railway
pedestrian and cycling facilities
relocating the Kororo Public School bus interchange, and
three grade separated interchanges.

OUR ROLE:

ConnellGriffin provided Transaction and Commercial Management Services to TfNSW for the project.

Our services included:

organise and facilitate the Industry Briefing / Market Sounding;
leading the preparation of the pre-registration, ROI, RFT and SWTC documents;
develop and implement the innovative procurement process unique to the project including developing the D&C Deed commercial principles, which:
allowed tenderers to propose amendments to the technical requirements to reduce their tender price;
provided mandatory technical criteria that must be complied with;
included a maximum contract value that could not be exceeded.
Manage the development of the D&C Deed including liaising with the TfNSW Senior Legal Counsel and the Legal Advisor, including the development of the first C91 collaborative D&C contract to be used on a TfNSW I&P project;
develop, implement and facilitate the highly interactive tendering process;
manage the pre-registration, ROI and RFT processes which included all correspondence between TfNSW and the market;
management of all evaluation processes for both price and non-price work streams, which included facilitating and presenting on outcomes of the evaluation, and preparing the evaluation report;
capture and manage the project issues resolution process, and resolve various complex technical and commercial issues;
facilitate and support the project team with the INSW Gate 3 & 4 reviews;
manage the negotiation, contract conformance and contract award phases.

ACHIEVEMENTS, SOLUTIONS AND VALUE ADDS:

Key successes associated with the services include:

designed & implemented an innovative procurement process that allows tenderers the flexibility to amend the SWTC technical requirements whilst still meeting TfNSW functional requirements to ensure the project budget is not exceeded;
effective and responsive leadership in the early phases of the transaction of the D&C Contract within the first month of our engagement;
development of commercial principles aligned with TfNSW’s objective of a more balance and equitable risk allocation;
the facilitation of the resolution of various complex technical and commercial issues to ensure clear commercial and technical positions;
development and implementation of a highly interactive tendering process adapted to remote working arrangements;
comprehensive review of documentation produced by the project team to ensure concise commercial and technical positions were communicated to tenderers; and
development of an SWTC incorporating lessons learned from recent TfNSW projects.
